Late Night Tort Serenade

Have you ever found yourself, red eyed at midnight, trying to reconcile the holding in "Wagon Mound #1" with the holding "Wagon Mound #2" or pondering how different our world might be if Cardozo's holding in Palsgraf v. Long Island R.R. had been followed by the rest of the courts instead of the dissent?

OK, maybe you haven't, but, I bet you have wondered, "why hasn't that Lemur posted anything in, like, forever???"

Well, your answer is simple... I have been pondering all those things listed above, and more. I have arrived at a simple conclusion: everything is a tort. Life is a series of negligent, tortious acts strung together like beads on a cheap necklace just waiting for an eager plaintiff to, snip, sever the entire thing.

I can't go out in public anymore. Not just because I'm constantly studying, but because I see torts everywhere. I see negligent people and they scare me. I scare myself.

Others have noticed the same thing... one of my classmates postulated that the only answer, the only solution, was for everyone to do nothing but sit in a darkened room, drink weak tea, and eat dry toast. I think he may be right.

I hate dry toast...
